As a community we wish to say NO and make a united call to put a stop to the Minn's State Government "one shoe size fits all" Low and Mid-Rise Housing Policy which is allowing developers to build large scale unit blocks in locations that are not suitable for such developments, such as the east side of Asquith, small parts of which were recently rezoned R3 that a lot of the community may not be aware of.

The Government's recent changes to the planning controls now allows developers to build unit blocks up to 22 metres high (6 storeys) in R3 zones within 400 metres of a station (with a bonus height allowance of 30% and additional floor space ratio if they include at least 10% affordable housing (so effectively 9 storeys at approx 28.95m in height)) with very little consideration for on the ground impacts and Council has very limited bases on which to say no.  It should be noted:

  • There are no 9 storey unit blocks on the west side of Asquith which is the actual Town Centre side of Asquith where unit blocks currently exist and are currently being built. 
  • The east side of the train station is not the "Asquith Town Centre".
  • There are no unit blocks on the east side of Asquith in existence.
  • The proposed location is unsuitable for highrise development.

As local residents, we stand against the proposed 33 unit, 9 storey development application at 4-6 Baldwin Avenue, Asquith DA/110/2026 (33 units) located just a few metres from a busy intersection regularly choked with vehicle and local school pedestrian traffic, is close to a bush fire zone, will overbear a heritage listed house and tree, where there is already insufficient parking and infrastructure to cater for such a large scale development and would also outscale existing homes and recent developments around it. It would also overlook a local school, cause loss of privacy and solar access to many surrounding homes and there are already approximately 45 townhouses and a 103 place childcare centre approved to be built but not yet constructed adjacent.

The "Baldwin Avenue Precinct, Asquith" has always been pegged by Council for townhouse development and we ask that the residents continue to be honoured with this type of development which is more suitable for this area. The subject site was already previously approved for the construction of 11 townhouses.

To allow a large scale unit development to be built in this area would be negligent on many levels. 

Why is this important?

Asquith is already experiencing significant residential growth on the west side of Asquith with the mass building of unit blocks up and down the highway, with still many more to be built. The east side is also experiencing growth with the recent changes to subdivisions and dual occupancy controls however does not have the same capacity or infrastructure as the west side to cope with such large scale developments. It is more suited to townhouses and dual occupancy growth.

Council have refused the developer's DA on the basis of 21 separate objections. There were also 150 resident objections. The developer has appealed and the matter is now in the conciliation process. If a resolution is not reached it will go before the Land & Environment Court for hearing.

The Sherbrook Road/Baldwin Avenue intersection is a very busy thoroughfare and with the continued growth of the area it will only get worse.  There are multiple development applications already approved for townhouses in the immediate vicinity that are yet to be constructed and there is a fear that if one high rise unit block is approved, new DAs will be lodged for more high rise unit blocks. If we don't stop this one, there could potentially be 5 to 6 highrises at this intersection.

It is important that we stand together as a community to say no to overdevelopment and highrise on the east side and to protect the safety of our families, our neighbours and our friends from the impacts of such large scale developments.

IMPORTANT UPDATE: We received notice on Friday 14 August 2026 that the developer lodged a new (amended) DA (DA/110/2026) (still 9 storeys) seeking a Variation Request to the Building Height to get away with this inappropriate development. An opportunity exists for objections/submissions to be lodged against the development by 2 SEPTEMBER 2026 at:

One of the key tests is that the proposal is required to be in the public interest which in this case is obviously not! Please lodge your written submission ASAP.
